The Pentagon’s AI Strategy vs. U.S. Law: A Monumental Contradiction

The Pentagon’s newly released Artificial Intelligence Strategy for the Department of War lays out an aggressive acceleration of AI adoption, emphasizing “speed wins” and accepting the risks of “imperfect alignment.” This is not just controversial — it stands in direct contradiction to multiple established U.S. policy frameworks and legal obligations.

Here’s why this matters, what laws and policies it violates or undermines, and why Congress must act.

1) Contradiction with the Department’s Own Ethical AI Principles

Established U.S. Department of Defense (DoD) policy requires that AI systems be developed and deployed according to five core ethical principles:

  1. Responsible — appropriate human judgment and care;
  2. Equitable — minimize unintended bias;
  3. Traceable — transparent and auditable methodologies;
  4. Reliable — explicit, well-defined uses with life-cycle testing and assurance;
  5. Governable — capacity to avoid unintended consequences and be shut down.

These principles are not aspirational rhetoric — they are formal policy grounded in law and doctrinal guidance that the Department itself adopted to ensure compliance with existing bodies of law, including the U.S. Constitution, Title 10 U.S. Code, and Law of War obligations.

Yet the new strategy explicitly treats ethics constraints and safeguards as “blockers” to be removed and even discourages the application of “ideological tuning” or policy constraints that might interfere with rapid deployment.

That is a legal problem. The Department may not, by internal memo, supersede codified ethical obligations that implement statutory and treaty obligations. If policy A says “explicit testing and assurance across the entire life cycle” and policy B says “ignore barriers to speed,” then the latter undermines a binding policy grounded in law.

2) Conflict with Federal Policy Requiring Concrete Safeguards

Independent of DoD’s internal rules, the White House Office of Management and Budget (OMB) has directed federal agencies to implement concrete safeguards to ensure AI does not harm public safety, civil rights, or civil liberties — or halt use if they cannot.

This directive applies to federal AI use broadly, and while certain intelligence and defense missions are exempt, the general legal principle remains: federal agencies must establish risk management, accountability, and transparency measures proportionate to AI use. Simply privileging speed over risk management runs counter to this policy.

3) Departure from Established Law of War and Human Oversight Requirements

DoD Directive 3000.09 — U.S. policy on autonomous weapons — clearly mandates that systems with lethal or kinetic potential be designed to allow commanders to exercise appropriate human judgment over the use of force.

If the new strategy emphasizes AI in battlefield decision support or “kill chain execution” without clearly defined human authority constraints or rigorous, verifiable testing, it risks contravening this directive.

4) Risk of Unlawful Discrimination and Bias

U.S. law prohibits discrimination and bias in government decision-making. The DoD ethics principles themselves mandate taking “deliberate steps to minimize unintended bias in AI capabilities.”

A policy that downgrades safeguards for bias detection and mitigation in favor of speed — especially across three million users at all classification levels — is not just risky; it may systematically violate civil rights norms and domestic legal mandates if deployed in ways that influence decisions about detention, targeting, profiling, or mission execution.

5) Transparency and Accountability Are Required by Federal Policy

Current U.S. federal directives — including the White House’s AI safety and transparency requirements — specify that agencies must publish inventories of their AI systems with risk assessments, and must appoint Chief AI Officers to oversee compliance with safety and civil liberties protections.

The Pentagon strategy’s emphasis on rapid rollout and elimination of “blockers” works directly against these mandates and weakens accountability, transparency, and risk assessment requirements in favor of speed.

6) “Responsible AI” vs. “Lawful Use” Language

The strategy reportedly mandates including “any lawful use” language in AI contracts, meaning a vendor’s only requirement is that an AI meets the legal standard for force.

But legality is a floor, not a safeguard. The law (including constitutional protections and human rights obligations) does not define safety, ethical sufficiency, or reliability for life-critical systems. Saying something is “lawful” doesn’t make it safe, proportionate, or ethically defensible — particularly in life-and-death contexts.

7) International Norms and Treaty Obligations

The U.S. has engaged internationally on military AI governance, including through the Political Declaration on Responsible Military Use of Artificial Intelligence and Autonomy, endorsed by more than 50 countries, which commits to norms including human oversight and adherence to international humanitarian law.

A strategy that purposefully sidelines ethical and governance stops in favor of speed undermines U.S. leadership in these normative commitments and risks violating treaty obligations or destabilizing global expectations.

8) Public Safety and Human Judgment Risk

Federal policy (not specific to DoD) recognizes that AI risks include lack of human understanding of AI outputs, inappropriate use, and overreliance on black-box systems — resulting in safety harms, discrimination, or loss of human judgment.

A strategy that accelerates deployment before adequate assurance frameworks are in place will only amplify precisely the risks that White House and federal AI policy directives are designed to mitigate.

The Law Is Not Suspended in War Rooms

Congress created exhaustive legal frameworks — in statute, presidential directive, and agency rulemaking — to ensure that as AI is integrated into federal systems, risks to life, civil liberties, civil rights, and safety are measured, mitigated, and governed.

A DoD strategy that:

  • bypasses ethical principles,
  • dismisses safeguards as blockers,
  • accelerates deployment without verifiable assurance,
  • and prioritizes procurement cadence over risk profiles

…is not just bad policy. It is inconsistent with federal law and directives aimed at protecting the American people and maintaining lawful, ethical use of force.

What Congress Should Do

Here are specific, congressional actions that could hold this strategy to legal standards:

  1. Require formal legal review and certification of the strategy’s compliance with:

    • DoD’s own ethical principles,

    • Law of Armed Conflict and human oversight rules under DoD Directive 3000.09,

    • White House AI transparency and safety directives.

  2. Mandate publicly disclosed risk assessments for all proposed AI systems before approval.

  3. Order independent evaluation of the claimed “remove blockers” language to determine whether it unlawfully waives or undermines legal requirements.

  4. Hold hearings on the strategy’s alignment with civil rights, civil liberties, and safety protections mandated by federal AI policy.

  5. Require clear definitions of what constitutes “imperfect alignment” and where human authority is retained — not vague assertions of urgency.

The Pentagon’s AI strategy may be ambitious, but law does not bend for expedience.

Federal AI policy — from ethical principles to safety and transparency directives — requires risk mitigation, human accountability, traceability, and life-cycle assurance. In the most consequential domain — national defense — American values and legal obligations are not optional accelerants.
